My Health My Data Policy
This My Health My Data Policy (the “MHMD Policy” or “Policy”) supplements the Privacy Policy and applies specifically to “consumers” as defined under the Washington My Health My Data Act (the “MHMDA”). It describes how Eze Marketing Inc (together, “Breeze,” “we,” “us,” or “our”) collect, use, share, and disclose Consumer Health Data in connection with the App and Website. Any capitalized terms not defined in this Policy have the meanings given to them in the Privacy Policy or the MHMDA.
This Policy applies to (i) residents of the State of Washington and (ii) individuals whose Consumer Health Data is collected in the State of Washington (together, “you” or “consumers”). It applies only to Consumer Health Data that is subject to the MHMDA and does not apply to information that is outside the scope of, or exempt from, the MHMDA.
For purposes of this Policy, “Consumer Health Data” (“CHD”) has the meaning given to it under the MHMDA. Generally, CHD is personal information that is linked or reasonably linkable to a consumer and that identifies the consumer’s past, present, or future physical or mental health status. CHD does not include information that does not qualify as CHD under the MHMDA, including Publicly Available Information, Deidentified Data, or information regulated by the federal Health Insurance Portability and Accountability Act (“HIPAA”).
This Policy supplements our Privacy Policy and does not supersede, replace, or otherwise amend it.
1. CONSUMER HEALTH DATA WE COLLECT
Depending on how you interact with the Service and the choices you make, we may collect, and share as described in Section 4, the following categories of Consumer Health Data:
- Information about social, psychological, behavioral, and wellness interventions, including information about your lifestyle and habits (such as alcohol consumption, smoking status, and daily behavior patterns) and the responses you submit through our quizzes and surveys, to the extent this information relates to your physical or mental health status;
- Information about your bodily functions, symptoms, goals, or self-reported measurements that you voluntarily provide in connection with your use of the Service;
- Information that identifies your attempt to seek, access, or learn about services that allow you to assess, measure, improve, or maintain your health or wellbeing, including your use of and interactions with our wellness-related content, plans, and features; and
- Any other information we use to infer or derive data about your past, present, or future physical or mental health status, such as the personalized wellness plans, goals, and recommendations we provide for you.
2. SOURCES OF CONSUMER HEALTH DATA
We may collect Consumer Health Data from the following categories of sources:
- Directly from you, for example when you register, complete a quiz or survey, set your goals, make a purchase, or contact our support team;
- Automatically from the devices you use to access the Service and from your interactions with the App and Website, including through cookies and similar tracking technologies;
- From our affiliates and service providers with which we have a contractual relationship and to which you have provided your personal data.
3. HOW WE USE CONSUMER HEALTH DATA
We – and our service providers – may collect, process, and use the Consumer Health Data described in this Policy for the following purposes:
- Providing, operating, and maintaining the Service, including creating and delivering your personalized wellness plan based on your quiz responses;
- Maintaining and servicing accounts, providing customer support, and processing your purchases, subscriptions, and transactions;
- Personalizing and improving the content, features, and recommendations we offer you;
- Communicating with you, including sending transactional messages and, where you have consented, marketing communications;
- Ensuring the security, integrity, and reliable operation of the Service, and detecting, preventing, and addressing fraud, misuse, and other unlawful activity;
- Conducting research, analytics, and data analysis to maintain and improve the quality and safety of the Service;
- Complying with our legal obligations, exercising and defending legal claims, and enforcing our agreements; and
- Any other purpose for which you have given your consent, as required by the MHMDA.
Where the MHMDA requires your consent to collect or process Consumer Health Data for a particular purpose, we will obtain that consent before doing so.
4. HOW WE SHARE CONSUMER HEALTH DATA
We may share Consumer Health Data only as necessary for the purposes described in this Policy, and only with the following categories of recipients:
- Affiliates. We may share Consumer Health Data within our corporate group, between entities that are owned by, own, or are under common ownership with us.
- Service providers (processors). Vendors that process Consumer Health Data on our behalf and under our instructions, including providers of cloud hosting and infrastructure, data analytics, communications and customer support, crash and performance monitoring, and payment processing.
- Legal and government authorities. We may disclose Consumer Health Data to government authorities, law enforcement, courts, or similar third parties to comply with applicable law or valid legal process, to assert or defend legal claims, and otherwise as permitted or required by law.
- Corporate transactions. We may disclose Consumer Health Data in connection with a reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock, including in connection with any bankruptcy or similar proceedings.
- Other third parties at your direction. We may disclose Consumer Health Data to any other third party with your consent or at your direction.
All service providers and other recipients that process Consumer Health Data on our behalf are required, by contract or similar restrictions, to protect it and to use it only for the purposes for which it was shared.
5. YOUR RIGHTS UNDER THE MHMDA
If you are a consumer under the MHMDA, you have the following rights with respect to your Consumer Health Data:
- The right to confirm whether we collect, share, or sell your Consumer Health Data;
- The right to access such Consumer Health Data, including a list of the third parties and affiliates to whom your Consumer Health Data has been sold or shared;
- The right to withdraw your consent to our collection and sharing of your Consumer Health Data;
- The right to withdraw your consent to any sale of your Consumer Health Data; and
- The right to have your Consumer Health Data deleted, subject to the exceptions permitted under the MHMDA.
To exercise any of these rights, please contact us at support@bsnj.co. To protect your Consumer Health Data, we will take steps to verify your identity before responding, and we may ask you to provide information sufficient to verify your identity and to describe the right you wish to exercise. We will respond within the time period required by the MHMDA.
Appeals. If we decline to act on your request, you may appeal our decision by contacting us at support@bsnj.co and identifying your message as an appeal. If your appeal is denied, you may submit a complaint to the Washington State Attorney General at www.atg.wa.gov/file-complaint.
6. CHANGES TO THIS POLICY
We reserve the right to amend this Policy at our discretion and at any time, for example to reflect changes in our practices, the Service, or applicable law. When we make material changes, we will notify you by posting the updated Policy and revising the effective date.
